The result was that both bills were shelved for the time being. But since then, something new has popped up on the techie radar.<span id="more-612"></span></p>
<p>ACTA, the Anti-Counterfeiting Trade Agreement is, <a href="http://en.wikipedia.org/wiki/Anti-Counterfeiting_Trade_Agreement">as stated by Wikipedia</a>, &#8220;a proposed plurilateral agreement for the purpose of establishing international standards on intellectual property rights enforcement&#8221;. (A plurilateral agreement, for those of you who, like me, are not up on political lingo, is a term used by the World Trade Organization to describe an agreement between more than two countries, but not a great many).</p>
<p>The idea behind ACTA is that it would create international rules concerning intellectual property. ACTA encourages internet service providers to retain and provide information about suspected copyright infingers and grants law enforcement the power to persue criminal investigations against suspects who may have commercially profited from their infringement.</p>
<p>Sounds all well and good, right?</p>
<p>Well&#8230; not so much. It also allows criminal investigations against individuals without probable cause.</p>
<p>But what is really disturbing is that President Obama chose to sign (several months ago) this agreement without Congressional approval by calling it an &#8220;executive agreement&#8221; rather than a &#8220;treaty&#8221; (even though other countries enthusiastically refer to it as a treaty). Even if it is decided that it&#8217;s not a treaty, the President cannot enter binding international agreements on matters under Congress&#8217;s plenary power&#8230; which, according to <a href="http://www.usconstitution.net/const.html#A1Sec8">Article 1, Section 8 of the U.S. Constitution</a>, intellectual property and copyright is one of.</p>
<p>In short, Obama is trying to circumvent Congressional authority on ACTA.  Senator Wyden (who, some might recall, was a very vocal opponent of PIPA and threatened to filibuster it if it came to a vote) has <a href="http://www.techdirt.com/articles/20111012/10072216326/senator-wyden-asks-president-obama-isnt-congress-required-to-approve-acta.shtml">taken notice of this</a> and sent President Obama a letter on the subject.</p>
<p>In addition to its questionable constitutionality, many of the same concerns raised about SOPA and PIPA have been raised reguarding ACTA. The European Union, which seems to have finally relented and <a href="http://www.thejournal.ie/ireland-and-eu-to-sign-controversial-acta-treaty-tomorrow-336764-Jan2012/">plans to sign tomorrow</a>, had particular worries about the effects on individual speech.</p>
<p>There is now a <a href="https://wwws.whitehouse.gov/petitions/!/petition/please-submit-acta-senate-ratification-required-constitution-trade-agreements/VgZJGZMt?utm_source=wh.gov&amp;utm_medium=shorturl&amp;utm_campaign=shorturl">petition on WhiteHouse.gov</a>, demanding that ACTA be brought before the Senate for ratification. I would encourage people to sign it. Even if Congress ultimately ratifies it (which, given the current goings-on regarding IP and copyright legislation seems unlikely), at least then the decision to do so would have been made constitutionally.</p>

<p>To recap&#8230;<span id="more-606"></span></p>
<p>Around 8:00am EST Jan. 18, 2012 (and in some cases even earlier) sites all over the internet went dark. Some shut down completely, displaying only a page explaining why. Some intercepted their visiters, hitting them with a popup or splash page before letting them access content. Regardless of the method, the message was the same. The internet will not tolerate the passage of that SOPA and PIPA legislation.</p>
<p>Some of the biggest sites on the internet joined in, including the likes of Wikipedia, Reddit, Craigslist, and Mozilla. Even Google censored their logo in protest.</p>
<p>On Twitter, many users pledged not to tweet during the 12-hour blackout. Other users chose instead to tweet updates about the protest. And <a href="https://twitter.com/#!/herpderpedia">@herpderpedia</a> retweeted the more clueless Twitter user&#8217;s reactions to Wikipedia being down.</p>
<p>Around 10am, news hit the web that <a href="http://latimesblogs.latimes.com/technology/2012/01/sopa-blackout-sopa-and-pipa-lose-three-co-sponsors-in-congress.html">SOPA and PIPA had lost three of their co-sponsors in Congress</a>.</p>
<p>A little before 1pm TheVerge.com reported that <a href="http://www.theverge.com/2012/1/18/2716262/us-senate-websites-technical-difficulties-sopa-blackout">U.S. Senate websites were experienceing technical difficulties</a>&#8230; Webpages for Representatives crashed as well. The issues were <a href="http://blogs.denverpost.com/thespot/2012/01/18/beltway-blog-senate-house-websites-crash-from-so-many-sopa-complaints/54495/">due to a flood of traffic to their contact pages</a>, courtesy of Google.</p>
<p>SOPA opponents in San Fransisco <a href="http://www.mercurynews.com/breaking-news/ci_19768045">gathered for a demonstration</a> at Civic Center Plaza. <a href="http://technolog.msnbc.msn.com/_news/2012/01/18/10183154-sopa-pipa-protest-held-outside-senators-ny-offices">Protesters also gathered</a> outside of the offices of Senator Chuck Schumer and Senator Kirsten Gillibrand on 3rd Avenue in New York.</p>
<p>Senator Orrin Hatch, who voted to bring PIPA to the Senate floor, <a href="http://www.sltrib.com/sltrib/politics/53325410-90/hatch-online-bill-piracy.html.csp">backtracked his position</a>, saying &#8220;it is imperative that we take a step back to allow everyone to come together and find a reasonable solution&#8221;. Arkansas Congressman Tim Griffin, a SOPA co-sponsor <a href="http://arkansasmatters.com/fulltext?nxd_id=500202">issued a statement</a> that he would take a second look at the bill. In all, <a href="http://www.nytimes.com/2012/01/19/technology/web-protests-piracy-bill-and-2-key-senators-change-course.html">at least 10 Congressmen</a> changed their position on SOPA/PIPA.</p>
<p>At 4pm, it was reported that <a href="http://latimesblogs.latimes.com/technology/2012/01/google-anti-sopa-petition.html">4.5 million people had signed Google&#8217;s anti-SOPA petition</a>. Additionally, <a href="http://www.whitehouse.gov/blog/2012/01/18/numbers-103785">103,785 people signed a petition</a> asking the Obama Administration to protect an open and innovative internet at whitehouse.gov.</p>
<p>CEO of Red 5 Studios (makers of the MMO Firefall), <a href="http://www.tomsguide.com/us/SOPA-PIPA-League-For-Gamers-REd-5-Studios-ESA,news-13937.html">Mark Kern created the League for Gamers</a> in response to the ESA siding with SOPA and PIPA sponsors. First order of business? Asking the ESA to oppose the legislation.</p>
<p>Late Wednesday, Rep. Darrell Issa offically <a href="http://www.pcworld.com/businesscenter/article/248389/issa_introduces_sopa_alternative_in_the_house.html">introduced the OPEN Act in the House</a>. And alternative to SOPA, OPEN, while far from perfect, is noted as a significant imporvment.</p>
<p>I think it&#8217;s safe to say we&#8217;ve won the battle. The war continues.</p>

At the same time, I&#8217;ve noticed a trend. People who oppose SOPA are being <a href="https://twitter.com/#!/rupertmurdoch/status/158321072943542272">accused</a> of <a href="https://twitter.com/#!/rupertmurdoch/status/158317988284596224">wanting</a> to protect <a href="http://www.politico.com/news/stories/1211/70948.html">piracy</a>. (Google, in particular, has been singled out in this regard).<span id="more-534"></span></p>
<p>You’ll get no argument from me that piracy is a problem (albeit one that has been <a href="http://www.techdirt.com/articles/20111214/23451317095/ridiculous-lamar-smith-basing-his-plan-to-massively-regulate-internet-false-misleading-research.shtml">grossly exaggerated</a> by certain industries)&#8230; but SOPA is not the way to go about fixing it.</p>
<p>SOPA is the equivalent of trying to swat a fly with a rocket launcher. Yeah, you might kill the fly, but god only knows what else you’re going to blow up in the process.</p>
<p>For people who oppose SOPA, out biggest concern is not that it may hamper piracy and people&#8217;s ability to watch movies like Mission Impossible 3 for free, but rather that the overwhelmingly broad power of the legislation can (and almost certainly will) be abused by those who wield it.</p>
<p>On top of that, to say that SOPA will actually do anything to curtail online piracy is a big assumption&#8230; if piracy were really that easy to stop, it would have been done a long time ago. If someone wants something for free, odds are they&#8217;ll find a way to get it one way or another. <a href="http://nlb-creations.com/2012/01/14/anti-sopa-tools-for-webmasters-and-users-alike/">Tools to circumvent the effects of SOPA</a> have already been developed, which just goes to show that, if you don&#8217;t <em>understand</em> the internet to begin with, you shouldn&#8217;t try to <em>&#8220;fix&#8221;</em> the internet.</p>
<p>People who oppose SOPA don&#8217;t blatantly support piracy. We simply see the damage SOPA will do to the online ecosystem.</p>

<p><a href="http://americancensorship.org/">Stop American Censorship</a><br />
The Stop American Censorship website provides a variety of anti-SOPA tools. Everything from a form to send an email to your congress representatives, to petitions, to protest tools for Twitter and Facebook. It also has a good collection of informative articles and media.</p>

No SOPA is a plugin for the Chrome web browser that notifies you if you are viewing the website of a known SOPA-supporter by displaying a bar at the top of the page.</p>

Like the No SOPA plugin, Protest SOPA is a Chrome plugin that displays a notification bar when you browse any domain belonging to a known SOPA supporter.</p>
<p><a href="https://addons.mozilla.org/en-US/firefox/addon/desopa/?src=search">DeSOPA</a><br />
DeSOPA is a browser add-on for FireFox. According to its author, it is a proof of concept that SOPA will not help prevent piracy. DeSOPA works by contacting offshore domain name resolution services to obtain the IP address any requested website, and then accessing those websites directly via IP.</p>
<p><a href="https://addons.mozilla.org/en-US/firefox/addon/mafiaafire-piratebay-dancing/">MAFIAAFire: ThePirateBay Dancing!</a><br />
ThePirateBay Dancing! is another FireFox add-on for circumventing future SOPA blocks. Accoding to its author, the add-on automatically routes your website request via a random proxy. This not only has the effect of &#8220;unblocking&#8221; sites blocked via DNS/IP address at the ISP level, but also makes &#8216;tracking&#8217; you next to impossible.</p>
<p><strong>WordPress Blackout Day and Censorship Plugins</strong></p>
<p><a href="http://dev.codelabs.ca/project/reverse-sopa/">Reverse SOPA/Protect IP</a><br />
This plugin acts as a reverse blacklist, turning the tables on known SOPA supporters by &#8220;blacklisting&#8221; their IP addresses and not allowing them to access your website. Help the author out by forwarding him the IP addresses of any SOPA supporters you may have received an email response from (see the linked website for more information) and spreading the word about the plugin.</p>

<p>Facebook users are also urged to protest by joining the <a href="http://www.facebook.com/events/232028526874851/">&#8220;Stop Internet Censorship by Protesting SOPA event&#8221;</a> and posting censored photo galleries to their Facebook walls on the 18th.</p>
<p>WordPress users wanting to join in the protest might find the <a href="http://wordpress.org/extend/plugins/sopa-blackout/">SOPA Blackout plugin</a>, which adds a temporary 503 status and customisable page to your site automatically.  Blogspot users <a href="http://erratasec.blogspot.com/2012/01/january-18-sopa-blackout-day.html">can easily show their support</a>, too.</p>

			<content:encoded><![CDATA[<p>There&#8217;s a huge amount of opposition for the Stop Online Piracy Act (SOPA) from the public, which has resulted in delays of voting, numerous amendments, and a lengthy hearing process. All of which is good, because SOPA is an awful piece of legislation.  It&#8217;s been generating a lot of bad press on the web of late, and even <a href="http://news.yahoo.com/godaddy-goes-back-pro-sopa-stance-avoid-boycott-233806304.html" target="_blank">GoDaddy backed out</a> of their support for SOPA after faced with a boycott by disgruntled internet users.</p>
<p>But people are so focused on SOPA that they seem to have forgotten all about PIPA, which is due to go to the Senate floor for a vote as early as Jan. 24.</p>
<p>SOPA, which is admittedly the worst of the two bills, may not have much of a chance of passing at this point&#8230; but because it&#8217;s been so thoroughly vilified, it has allowed PIPA to slip through almost unimpeded. People seem to have forgotten that PIPA is just as dangerous as SOPA&#8230; and PIPA seems like it has a much better shot at passing.</p>
<p>It kind of makes you wonder if this wasn&#8217;t the plan all along.</p>

<p>It lets you add a list of items with various bits or meta data, and images, and display the list in any page or post.  It was more of a personal challenge than anything else.</p>
